Purpose of Classification PURPOSE OF CLASSIFICATION The purpose of this position is to assist the City Attorney and Deputy City Attorney in the provision of legal services to the City. The City can hire this role as an Assistant City Attorney I, Assistant City Attorney II, or Senior Assistant City Attorney, depending upon qualifications and experience.
ASSISTANT CITY ATTORNEY (TRANSACTION ATTORNEY) Assistant City Attorney I Salary: $85-987.26 - $128,980.90 Assistant City Attorney II Salary: $99,843.21 - $149,764.85 Senior Assistant City Attorney Salary: $109,174.56 - $163,767.40 The Assistant City Attorney will have experience and expertise in various legal matters and will work on all aspects of municipal law. Duties include providing legal advice to the City Commission, City Manager, and Department Heads. Other responsibilities include performing legal research and preparing legal opinions; preparing resolutions, ordinances, contracts, and other written documents; training employees or boards; and other tasks as needed.
The City offers various excellent benefits to employees, including enrollment in the City's pension plan and employer-paid vision, dental, and health insurance. This job classification is in Management Tier 2 for benefits purposes, which includes $100,000 additional life and AD&D insurance, a car allowance, a cell phone allowance, and seven (7) additional management vacation days per year.
SUPERVISION RECEIVED AND EXERCISED This position is classified as an exempt, at-will, full-time position. This position will be required to work on-premises five (5) days a week or four (4) days a week, with one (1) day working remotely.
Work is performed under the direction of the City Attorney; however, the employee is expected to exercise considerable initiative and independent professional judgment in performing the technical aspects of the job.
Employment is contingent upon passing a criminal background check.
Essential Functions ESSENTIAL FUNCTIONS As outlined herein, the following duties and functions represent the types of tasks performed within this classification. They are not listed in any order of importance. The omission of specific statements of the duties or functions does not exclude them from the classification if the work is similar, related, or a logical assignment for this classification. Other duties may be required and assigned.
- Draft, review, and negotiate a wide range of municipal contracts and agreements, including development agreements, procurement contracts, interlocal agreements, public-private partnerships, leases, and property transactions.
- Provide legal advice to the City Commission, City Manager, and Department Heads.
- Handle matters related to public procurement, including drafting RFPs and bid documents and resolving bid protests.
- Advise on land use and zoning issues, particularly development agreements and land transactions.
- Draft and review ordinances and resolutions.
- Conduct legal research and prepare legal opinions.
- Train City staff on contract law, procurement procedures, Sunshine Law, Public Records, and other municipal issues.
- Evaluate current City practices, policies, and procedures and work with City staff to develop and implement new policies and procedures.
- Collaborate with other departments to ensure compliance with federal, state, and local laws.
- Attend City Commission meetings and workshops as needed.
- Occasionally assist the litigation team with preparing and filing legal pleadings, briefs, and other litigation documents, as well as representing the City in state and federal court and administrative proceedings.
Additional Duties: Provides assistance or coverage to the City Attorney and Deputy City Attorney as needed.
Performs additional related duties as assigned and/or required.
Minimum Qualifications MINIMUM QUALIFICATIONS Undergraduate Bachelor of Arts or Bachelor of Science degree and degree of Juris Doctorate from a law school accredited by the American Bar Association. Minimum qualifications for each job classification are as follows:
Assistant City Attorney I: 0-5 years' experience practicing law.
Assistant City Attorney II: minimum of five (5) years' experience practicing law.
Senior Assistant City Attorney: minimum of ten (10) years' experience practicing law.
Must be admitted to practice law in Florida and be a member in good standing with the Florida Bar.
Must possess a valid Florida Driver's License and have and maintain an acceptable driving record.
Preferred: 5+ years in municipal or local government transactional law or related law.
Knowledge of Federal, State, and City laws, particularly those relating to municipal government's general administrative and regulatory functions.
Supplemental Information COMMUNICATION COMPETENCIES/K.S.A.'S Knowledge of Job : Knowledge of municipal law, including but not limited to providing legal services related to public procurement, public records laws, land use and zoning, labor and employment law, police, fire, contract drafting, construction law, code enforcement, public finance, and civil litigation including section 1983 liability.

PHYSICAL AND SENSORY REQUIREMENTS / ENVIRONMENTAL FACTORS: Physical Ability: Tasks require the ability to exert light physical effort in sedentary to light work, which may involve some lifting, carrying, pushing, and/or pulling of objects and materials of moderate weight (25 pounds). Tasks may involve extended periods of time at a keyboard or workstation.
Environmental Factors: Essential functions are regularly performed without exposure to adverse environmental conditions.
